They would only have to cut a deal with Fox if they wanted to give A New Hope another theatrical run. Anything else and Disney can do whatever it wants, as it just did by releasing Episode IV digitally last month.

If they had just been "misplaced" Disney would have their hands on them now. Reason I find it impossible for the original masters to actually be gone is without them doing further re-releases would be pretty much impossible. Can't have a 4k remaster if you don't have the original film to scan. Though a 4k version of the PT would be impossible thanks to Episodes II&III being filmed on 1080p digital cameras. I would laugh so hard if they actually just release them horribly upscaled.
