The Comics Code is pretty much the main reason superheroes took off the way they did; the draconian restrictions basically made it impossible to publish anything else interesting, but men in spandex foiling the plots of overdressed lunatics and the other unrestrained weirdness of cape comics could pass muster easily. Because it was Frank Miller. One of two comic book creators (the other is Alan Moore) who have kept DC in the black with The Dark Knight Returns and Batman: Year One. And he wanted to work with Jim Lee, who sold millions of comic books back in the 90s and continues to be a popular and bankable artist despite most of his former Image colleagues either fading away or choosing to do non-comic book stuff (like make toys).

Back then people didn't really realise how far Miller had fallen. If Miller wanted to do a book like All-Star, Editorial would just let him do it and hope that he was actually going somewhere with it, which was sort of the feeling with everybody who bought it as well. Of course we never got to see where Miller was going with it because Jim Lee can't stick to a bloody deadline.
