Well it was decided on the basis of 14th amendment; almost 150 years in effect, but it did not occur to anyone at all that it guranteed gays' right to marry in all that time. Until public opinion about gay people shifted. This actually comes down to some interesting legal and cultural differences between places like Denmark and the U.S.

Denmark actually has a state religion. The government is partially responsible for managing and maintaining the church there, and the highest position in their religion is appointed as part of the government.
