I think the FBI being involved at all IS evidence of the swatting (attempt). I mean, assume that Acid does sell/manufacture guns, and is licensed to deal to federal officers. Pretty sure there's evidence this is so, but I'm not positive.

That means he will be VERY easily traced in the event he is going through shenanigans. Since they already have his employment, it would be trivial to find his last known address and pay him a visit. There is no need for it to be an emergency response, therefore, it is not even remotely swatting(Which requires a fake situation to promote an emergency response by local law enforcement, like the SWAT team)
tl;dr: If the illegal situation is real, and the response isn't emergency, it is NOT swatting.
