Same shit happened when Kozyndan (they were behind the art direction of American McGee's Bad Day LA) were contacted by Sony to design ads for tv screens. Sony rejected the artist project and that was it. Except a few months later, Sony ran its ad campaign that looked oddly similar to what project submitted by the artists. That was years ago and I don't think they ever brought this affair to court.

I wouldn't be surprised if that were true: plagiarism is pretty common, and even more since the emergence of the Internet and the ease to obtain your own space online to share your work. And it only gets worst for artist every day.
