Something about this story doesn't seem right, his fellow two partners/friends blow all the money and he can't sue them.
2 partners/friends he knew for 11 years, not just a nobody programmer like the one who ran off with a bunch of money with no work like in the Yog Adventures/Winterklew Kickstarter failure.
It's seems like a way to pass blame over reckless money loss and just get away with it, without any further investigation.

Sim Ant came out 25 years ago, if EA/Maxis wanted to make a new one they a long enough time to do it. It's never been available on any digital store.
The game is abandonware. You can even it from the Internet Archive for free.

Or other abondonware sites.

There are other city simulator games and yet EA never sued over those being like Sim City.
Heck, if EA wanted to sue over an "ant simulator" they would have done it when the game was announced.
