Currently under the development of a simple monster girls themed monster breeder game.

Going to be an RPG-essque, resource management, monster breeder.

Anything you guys would like to see I can keep you all updated in this thread.

Title of the game is "Monster Maker".

How many are on your team? What roles are they filling?

Regarding gameplay, could you elaborate? Maybe tell us some games it's comparable too.

What engine are you using? (Or what language and libraries)

Will it have VA?

Also what are you planning in regards to erotic content?

In anycase, assuming you're serious (Not stealing art, have actual experience developing a game, have formed a suitable team (There are far too many idiots who say "I'm going to make a game", but of coarse they never do because they have neither the knowledge nor skills and the few that actually do rarely actually finish the project)) then I look forward to it. The more Monster Girls games out there the better.

One of the members of our team worked for Kenkou Cross to translate the monster girls encyclopedia into English. His name is credited.

Yes I do, same guy, but we will not be doing much in the way of art because this game dev project is just for fun.

I thought that was a very specific genre.

Think tamagachi, except you are managing monster girls and breeding the like pokemon. The game will also have RPG elements without itself being an RPG. (Like pokemon.)

I mean you have two genres listed that don't usually go together so I can't get a picture of what the game would look like in my head. is it going to be more of a resource management game like princess maker with lots of menus and charts, or is it going to be more like pokemon where you can roam around a map and manage your inventor through drop down menus?

GMS is not a good choice of engine, but if that's what you and you're teams most comfortable with it can't be helped.

That's a shame, the main reason people play erotic games is the art and erotic content. Maybe you're better of just making a safe for work game.

Also I forgot to ask in my first post, but Do you perhaps have a devblog (Wordpress, tumblr etc) that those who are interested can follow? Or do you intend to keep this thread up to date?

No, it's never acceptable outside of being used as a temporary placeholder for in-house builds (Something the public will never see). Even then it's a bad idea over using your own crude place holders, as they assets may not meet your games technical specifications (image resolution etc).

The bigger issue is people using stolen art for everything, which results in; potentially mixed artstyle (assuming multiple sources were used (See those shitty old erotic flash games that literally have images taken from google images)), public criticism (thus loss of popularity and reputation, any traffic the game gets will be negative), potential DCMA (assuming it actually get's popular), images that don't actually suit the game (setting/characters doesn't match, resolution is wrong etc), and a mountain of other issues.

I do have permission to use the artwork from MGE, and some "proprietary" images and layouts from the MGE book itself. Again, we have been in contact with K.Cross already.

different engines are good at different things, but I'm still unclear on what your game looks like so it's hard to say what's best for you. I haven't used it myself but GMS churns out platformer and action games almost exclusively; I've read that how the language and logic is structured make it difficult to use it for anything more complicated.

Fair use is aimed at meta-level stuff regarding a copyright work, such as "commentary, search engines, criticism, parody, news reporting, research, teaching, library archiving and scholarship". This lets you include some Lion King art in your news article, review, or history lesson, etc. No doubt the game you're making does not fall in this category, but even if it did, being FREE isn't a free pass: "the noncommercial purpose of a use makes it more likely to be found a fair use, but it does not make it a fair use automatically".

I'm rather surprised you have a team of nearly 10 people in this business and came to the conclusion that you can infringe copyright just because you're not making money. Is piracy ok when you don't make money? Being non-commercial only matters when a copyright holder chooses to grant permission based whether your use is commercial or not, e.g. Creative Commons Non-Commercial licenses. Think of it this way, if being non-commercial equaled fair use, there wouldn't be a need for non-commercial licenses to exist.

It's funny that you chose to mention Disney, the most infamous company when it comes to copyright.

Read the quoted paragraph more carefully. What matters is the *copyright owner's* ability to exploit his work. Also: "exploit" is a technical term without any negative connotations.

Releasing someone's stuff for free won't gain you any profit, but he could lose sales as a result of your actions. He would therefore be justified in asking you to cease & desist your infringement.

In this case it's entirely moot since you obtained permission – kudos for doing so, by the way!

Anon9988's general point is correct, though: gratis does not automatically absolve us of our liability for copyright violations.

I'd say there are other ways in which you benefit, but it's not my legal battle to fight. Critcally, you are missing that fact that all four factors, and then some, are considered. You can't just meet one to call it fair use.
