The character is copyrighted, yes. But fanart is an exception in the legal terms. I don't have the exact terms just laying around, but even if they wanted to stop the fanart, it'd never stop. They're much pickier about people using her for advertising (posters for concerts, album covers, car commercials(yes, really), concerts themselves, public appearances (Letterman), etc.) than they are about people just drawing her. It's a bit of a confusing situation.
