Because the entire movie is intended to evoke the same feeling as ANH, following the basic sequence of:
Droid takes info for rebellion from doomed mission and hides on desert planet, meets lonely person >>> person with droid meets other person and leaves home for first time to aid rebellion >>> person encounters superweapon, must conduct rescue mission >>> person destroys superweapon
It isn't BB-8 that's the rip-off, it's the entire fucking sequence of events. The Luke plot is just a chopped and screwed version of Yoda.

Whoop de fucking doo, nobody was complaining about his character wearing black. He's one of the less bullshit parts of the movie.

She's not intended to be a rip-off in the sense of a color swap, she's intended to be the "badass never-see-the-face supporting character that's hyped up because she's so totally badass guys"
You seem to think that it requires literal shot-for-shot remaking before it can count as a reused element, not understanding that it was still incredibly lazy storywriting and hilariously poor characterization relying entirely off the "wink wink we totally know what series we're making guys, aren't all these references great?" fake-ass nostalgia
