Oregon Bill Passes Expanding Background Checks for Gun Sales

An Oregon bill expanding background checks to encompass nearly all gun sales in the state made it through the Legislature Monday, overcoming obstacles that stymied two previous attempts to pass similar laws.

The measure now heads to Democratic Gov. Kate Brown, who has indicated support. Her signature would make Oregon the eighth state to require screening before firearms could be transferred between private, unrelated owners. No other states have passed such legislation this year, advocates said.

Supporters have tried twice before to expand background checks, saying it closes a loophole that allowed people to purchase firearms online without a review. Neither attempt made it past a Senate vote, but Democrats managed to increase their majorities in both chambers after last year's election, partially because key candidates in the Senate were backed by billionaire Michael Bloomberg's gun control group, Everytown for Gun Safety.

The bill requires background checks on most private sales and transfers, except those between close family members such as spouses or siblings. There are some exceptions, such as sharing a gun while hunting or handing over a firearm for use at a shooting range.

Once the measure takes effect, private sales would need to happen in front of a licensed gun dealer who would run the check through the Oregon State Police.

There is an exception for gun sellers and buyers who live more than 40 miles from each other. In that case, the seller could send the firearm to a dealer near the buyer, who would then run the check and hand over the gun to the buyer if they're cleared.

The bill has born intense opposition from gun rights' supporters and every legislative Republican has voted against it. Many cited law enforcement officials in their districts who said they wouldn't enforce the law or that it would be difficult, if not impossible, to enforce.

Why 1 Sheriff Won't Enforce Gun Background-Checks

Oregon’s new law requiring criminal and mental health background checks for private gun sales has just gone into effect. Background checks were already required for sales by licensed dealers or at gun shows.

This hotly debated legislation does contain exemptions. For example, gun transfers among family members aren’t don’t require background checks, nor do temporary loans for hunting trapping, or target shooting. Still, some Oregon sheriffs say they won’t enforce the new law, including Josephine County Sheriff Dave Daniel.

OPB’s All Things Considered Host Kate Davidson spoke with Sheriff Daniel about his stance.

"… If you’re talking about investigating some type of a gun crime, where you have a person to person crime or potentially a property crime, if it comes across our desk we’ll look at it. However, in the totally of the investigation it is very low on a priority list as to whether a person went through some type of a background check.

The bad people are going to get guns regardless, whether this law makes a difference or not in how they do their gun transfers. I don’t think the state of Oregon really knows how big of an issue this is going to be yet. I know the Oregon State Police are going to have to ramp up their efforts in their firearms division just to try to run all these criminal histories on people should everybody start to follow this law."

Lane County Won’t Enforce New Draconian Firearm Background Check

Lane County didn’t say no to this law for the hell of it, they came up with some very good reasons why they wouldn’t enforce the gun control.

1. Constituents feel it is an obvious violation of rights afforded by the Second Amendment

2. This form of gun control is difficult to enforce, you would think “private gun sales” are hardly done at the farmers market

3. Prosecution of citizens who break this law would be far too expensive

So not only does the law infringe on people’s Second Amendment rights, but it also places a huge burden on Oregon’s local governments.

We essentially have a law that takes away constitutional rights, hampers the effectiveness of local government, and places an unnecessary strain on law enforcement.

I’d be willing to wager gun related deaths doesn’t drop by a single percent in Oregon because of this law. Lane County is doing the right thing by refusing to enforce this self-serving piece of legislative garbage.

I agree. People need to draw a line in the sand. Mine is at my front door. My guns are behind that line, cross it, die. If enough people act upon that measure - in defense - no tyranny will be able to subjugate this nation as a whole.
