COLUMBUS – Only a dozen states allow people to have sex with animals, but Ohio is one of them.

Bestiality isn’t banned under Ohio law, but Sen. Jay Hottinger, R-Newark, and Sen. Jim Hughes, R-Upper Arlington, want to change that. Their proposal would make bestiality a second-degree misdemeanor punishable by 90 days in jail and a $750 fine.

“There’s a problem with part of the underbelly of our society,” Hottinger said. “We should move forward to make sure it’s not behavior that is acceptable in the state of Ohio.”

How big of a problem is bestiality? Ohioans might be surprised, Hottinger said.

A significant number of advertisements online show Ohio residents seek animals for sex, Hottinger said. In 2011, a Shelby man was convicted of animal cruelty for having sex with his dog. This fall, a New London man was accused of having sex with his animals.

These offenders can be charged with animal cruelty but aren’t punished for having sex with animals, said Mary O’Connor-Shaver, a steering committee member with Ohio Voters for Companion Animals. Other states, including Kentucky and West Virginia, don't ban the practice, making it difficult to prosecute.

“We don’t prosecute these cases, because it’s so difficult to prosecute under Ohio law,” O’Connor-Shaver said.

Under the proposed changes, sexually abused animals could be removed from the care of suspected offenders and those convicted of bestiality could be ordered to take a psychological exam. Research shows abuse of animals can lead to abuse of humans.

But animal advocates want the bestiality ban to punish offenders more seriously. They would increase the crime to a first-degree misdemeanor and the possibility of a felony offense for repeat offenders. Also, judges should be able to ban offenders from owning animals permanently, O’Connor-Shaver said.

Hottinger and Hughes had hoped to add a ban on bestiality into the state budget passed last June. Neither lawmaker wanted the attention that the troubling offense would generate. But the proposal didn’t make the cut.

“It’s just a disturbing topic that some people would rather not talk about,” Hottinger said. "No one is supporting or condoning bestiality in the General Assembly."

Hughes and Sen. Kris Jordan, R-Ostrander, have tried unsuccessfully in the past to make bestiality illegal, but proposals haven't gone far. Still, Hottinger said he’s optimistic lawmakers will ban the activity. The bill, which had a committee hearing on Wednesday, has not received any opposition.

LANSING, MI — A pair of bills approved by the Michigan Senate would, together with companion bills pending in the House, create a system aimed at preventing past animal abusers from adopting from any animal shelter in the state.

The legislation would give Michigan's nonprofit animal shelters and animal control organizations alike access to the state's Internet Criminal History Access Tool (ICHAT) tool. It would also ban those convicted of certain animal abuse from keeping animals for at least five years.

Sen. Rick Jones, R-Grand Ledge, sponsored one of the two Senate bills.

The former Eaton County sheriff explained his support for the bills when they were first introduced in March 2015.

"As a former sheriff I have unfortunately seen a lot of animal abuse," Jones said. "This legislation will make sure that once a person has victimized an animal they will not be allowed easy access to another victim."

Jones' Senate Bill 219 would require Michigan's courts to order those convicted of certain crimes against animals, as part of their sentence, to neither own nor possess an animal for at least five years. For minor offenses, the five-year ban would only be mandatory on the second offense.

The five-year period would start after the date of sentencing or the date of release from incarceration, whichever is later.

Offenses that would result in a mandatory 5-year ban and a potential permanent ban on animal ownership include the following felonies:

• Various animal fighting, baiting and target shooting offenses

• Killing, torturing, mutilating, maiming or disfiguring an animal

• Poisoning an animal or knowingly exposing an animal to poison

• Sodomy

• Bestiality

Bieda's bill would waive the usual fee charged by the Michigan State Police to run a background check through the ICHAT system for any nonprofit animal shelters using it to check a potential adopter's criminal history.

Lawmaker Says Removing Sodomy Ban Would Kill An Important Animal Protection Bill

The Michigan Senate has passed a bill that effectively reaffirms the state's unconstitutional law making sodomy a felony punishable by up to 15 years in prison.

Michigan is one of more than a dozen states that still have sodomy bans on the books, despite the U.S. Supreme Court's 2003 ruling in Lawrence v. Texas declaring them unconstitutional.

Some states' sodomy laws specifically target gay relations, but Michigan's is among those that make oral and anal sex crimes illegal regardless of whether they're same-sex or different-sex. Michigan is also one of several states with a sodomy ban that's intertwined with a prohibition on bestiality – effectively equating the two. The law makes it a felony for anyone to commit "the abominable and detestable crime against nature with mankind or with any animal." If the person is already a sex offender, violations are punishable by life in prison.

For the last several years, Michigan legislators have been trying to pass an important package of bills referred to as Logan's Law, designed to keep pets out of the hands of animal abusers, according to The Detroit Free Press. Among the bills in the Logan's Law package — named for a Siberian husky who died tragically after acid was intentionally poured on him — is Senate Bill 219, by GOP Sen. Rick Jones. In addition to barring convicted animal abusers from owning pets for five years, SB 219 would update language in the state's ban on bestiality and sodomy as follows:

SB 219 passed the Senate Thursday, with the above language intact, and is expected to be considered by the House as early as next week.

This might seem like a great opportunity to finally remove the unconstitutional sodomy ban from the books, by simply striking the words "either with mankind or" from SB 219. However, Sen. Jones told The New Civil Rights Movement that such an amendment would jeopardize the whole bill.

"The minute I cross that line and I start talking about the other stuff, I won’t even get another hearing. It’ll be done," Jones (photo, above) said. "Nobody wants to touch it. I would rather not even bring up the topic, because I know what would happen. You’d get both sides screaming and you end up with a big fight that’s not needed because it’s unconstitutional."

Jones added that he believes the only way to repeal the sodomy ban would be a bill striking all unconstitutional laws from the state's books.

"But if you focus on it, people just go ballistic," he said. "If we could put a bill in that said anything that’s unconstitutional be removed from the legal books of Michigan, that’s probably something I could vote for, but am I going to mess up this dog bill that everybody wants? No."

BAKER — Goats can prematurely die for many reasons, including parasite infestations, metabolic diseases and poisoning.

But Susan Matuska believes her pet goat, Rachel, didn't have to die on Feb. 1.

“She was covered in blood,” Matuska said. “A veterinarian came out and found evidence of rape.”

A man sexually attacked the goat in late November, Matuska said, adding she believes Rachel's death directly resulted from that trauma.

But the veterinarian doesn't know what someone used to penetrate the 7-year-old animal, and deputies responded to Matuska’s Dad’s Road home, but the Florida Department of Law Enforcement couldn't find semen, “and there was no other evidence to support the claim” of rape, said Michele Nicholson, spokesperson for the Okaloosa County Sheriff’s Office.

Now, all Matuska can do is protect her seven other pet goats, which meant spending $4,000 to install a security system.

Humans having sex with animals is known as bestiality, or zoophilia. Goats are most often the target in Northwest Florida for these types of sexual attacks.

A Caryville newspaper recently reported on Sharon Cruz-Pecina, who believes at least three of her goats had been attacked “multiple times” and that the assaults are continuing on a regular basis.

Sex crimes against animals became illegal in Florida in 2007 after a 48-year-old man raped and killed a goat in Mossy Head. The man was charged with animal theft and sentenced to 11 months and 29 days in jail.

So the question remains: Why would someone have sex with goats?

Dr Anil Aggrawal, who teaches forensic medicine at the Maulana Azad Medical College in New Delhi, India wrote about the topic in the 2011 Journal of Forensic and Legal Medicine.

The 10 types of zoophiles, as broken down by The Independent newspaper, are as follows:

"Sadistic bestials — those who derive sexual arousal from the torturing of animals (known as zoosadism) that does not involve sexual intercourse with the animal.

"Opportunistic zoosexuals — those who have normal sexual encounters but would have sexual intercourse with animals if the opportunity arose.

"Regular zoosexuals — those who prefer sex with animals than sex with humans (but are capable of having sex with both).

Zoophiles said at the time that their sexual relations with their animals were mutual, and that their pets — who they prefer to be called their “partners” — could express if they wanted sex. Animal rights activists criticized zoophiles, arguing they put animals in harm’s way. Having sex with animals was legalized in Germany in 1969, except in cases where the animals proved to have suffered significant harm.

"We see animals as partners and not as a means of gratification,” Michael Kiok, chairman of the Zoophile Engagement for Tolerance and Information group, said at the time to the BBC. “We don't force them to do anything. Animals are much easier to understand than women."

Proponents of a bill that would ban the sexual abuse of animals told lawmakers Monday that New Hampshire is one of only a few states that still legally permits the practice, creating a de facto haven for local and out-of-state perpetrators.

“Please pass this bill and give law enforcement and prosecutors in this state the tool they need to enforce these laws,” Rep. Katherine Rogers, a Concord Democrat and the bill’s prime sponsor, told members of the House Criminal Justice and Public Safety Committee. “It’s unfortunately something that’s needed, and New Hampshire shouldn’t be one of the few states that doesn’t have it.”

The state is one of just 10, including Vermont, that does not explicitly prohibit sexual contact with animals. Perpetrators are still subject to charges of animal cruelty, a misdemeanor, but those can be hard to prove, and animal advocates insist they don’t go far enough.

Rogers’s bipartisan bill, however, has drawn criticism from the farming community, whose representatives, including Commissioner of Agriculture Lorraine Merrill, urged committee members to consider the consequences such legislation could have on normal animal husbandry practices. The bill would currently exempt just medical procedures and commercial farming, which omits people like subsistence farmers and those who might own a dairy cow or two, they argue. They suggest reworking the bill or abandoning it altogether for now.

“Just because the word ‘bestiality’ is not used in our statutes does not mean it’s not covered,” said Robert Johnson, a lobbyist for the New Hampshire Farm Bureau.

Bestiality is sexual activity between a human and an animal, usually a dog.

Jeremy Hoffman, a Virginia police detective and expert on the topic, insisted that farmers of any kind aren’t likely to be affected by the law.

“I don’t believe that’s in the spirit or the intent of the bill, and I can’t foresee any reasonable prosecutor attempting to use this bill in that fashion,” he said, responding to the concerns.

Bestiality drew attention in New Hampshire in 2014 when law enforcement investigating the homicide of a Keene man found video clips of his roommate having sex with dogs. That man, Nicholas Coll, was charged with animal cruelty and ultimately sentenced to one year in jail for having sex with two dogs, according to the Keene Sentinel. He was not required to register as a sex offender.

New Hampshire does appear, at least online, as a destination for those interested in the practice. Hoffman said one internet forum had 194 separate advertisements as of last week, with more than 650 responses. Two threads specifically dealt with the need to kill Rogers’s legislation.

“Without meaningful legislation, New Hampshire’s numbers will continue to grow,” Hoffman said.

No one spoke in support of bestiality at the hearing Monday.

Supporters of the bill, including the New Hampshire Coalition Against Domestic Violence, argue that anyone who has sexual contact with an animal for his or her own personal gratification should face felony charges. The bill as written would impose a Class B felony, punishable by up to seven years in prison. Coalition spokeswoman Amanda Grady Sexton said committee members have discussed amending the bill down to a misdemeanor, at least for a first offense. They will vote on that Tuesday, she said, adding that the group opposes the change.

Several proponents suggested that the abuse of animals is a common precursor to human abuse, and that this kind of behavior could lead be a “gateway drug” to human sexual abuse.

David Rotman, a Merrimack County prosecutor, said a ban would make it easier to prosecute animal sexual abuse, as the current animal cruelty statute requires proof of physical harm, which, like human sexual abuse, is often difficult to prove.

“If the Legislature wants to criminalize bestiality, I think a statute that specifically addresses these actions would more effectively put the public on notice about what’s prohibited, and ensure more effective prosecution,” Rotman said.

House Bill 1547 would make “bestiality” a crime because existing animal cruelty laws are ineffective in addressing the problem, supporters say.

On Tuesday, the House Criminal Justice and Public Safety Committee changed the bill to address concerns raised by farmers at a public hearing the day before, and then approved the new version on an 18-0 vote.

At the public hearing Monday, Nancy Holmes of New Boston told the committee the bill intrudes into normal animal husbandry practices, the breeding of hybrids between species and the transfer of animals for breeding.

Others said the bill makes exceptions for commercial breeders and veterinarians but not for farmers who want to breed their own animals or breed a horse and donkey to create a mule.

The committee also changed some definitions and clarified what would be a crime under the new legislation.

The prime sponsor of the bill, Rep. Katherine Rogers, D-Concord, told the committee at the public hearing that bestiality exists in the state and stronger protections are needed for animals.

New Hampshire is one of 10 states that do not specifically prohibit bestiality.

The House will vote on the bill later this month.

Nathaniel Erskine-Smith, elected in the Toronto riding of Beaches-East York, has tabled a bill that he believes will bring Canada's animal welfare laws "into the 21st century."

But a veteran Conservative MP and critic has already blasted his proposed changes as "dangerous" for hunters, farmers, ranchers, and aboriginal communities.

Erskine-Smith's Bill C-246 — the Modernizing Animal Protections Act — sets out to achieve three key measures that are entirely reasonable and should win broad support, he told The Huffington Post Canada Thursday.

Erskine-Smith, a lawyer, insists he's done his homework and is just building off previous legislation introduced to the House of Commons by Liberals and New Democrats.

And it would update the definition of bestiality to mean, simply, sexual activity between a person and animal. While Erskine-Smith says that's what any reasonable person thinks it means already, a British Columbia Court of Appeal decision held that the criminal act requires penetration.

Accomplishing all this, however, will mean looking at animals as more than just property — a step that has set off alarm bells among some MPs in the past who fear such a move could jeopardize hunting rights.

The bill will soon move to the floor for a vote and we need your help to get it passed! Bestiality is illegal in most countries and US states. HB 1547 would make New Hampshire the 41st state with a specific ban against this practice.

Some contend that bestiality is not a "violent" crime. Nothing could be further from the truth. Not only is bestiality abhorrent and cruel, but it also often results in serious injury to or the death of the animal. Moreover, there is a strong relationship to interpersonal violence, including sexual assault of people:

Juveniles who sexually assault animals are more likely to later commit crimes of interpersonal violence; it is, in fact, the single strongest risk factor for future sexual abuse of children.

Among juveniles who had reported engaging in animal sexual assault, 95 percent had also sexually assaulted people.

In one jurisdiction in Virginia, of ten adult males convicted of crimes related to bestiality, eight had also been involved in crimes involving children (e.g., child pornography, soliciting sex from a minor).

Animal sexual assault is not the rare, isolated perversion people prefer to think it is. The explosion of the Internet both facilitates this crime and allows it to flourish by allowing and encouraging perpetrators to communicate with and seek out one another, find animals for sexual purposes, and share their encounters. Passage of HB 1547 would greatly enhance New Hampshire's ability to protect both animals and its communities—especially its children—from sexually violent offenders.

QCOSTARICA – Having sex with an animal (bestiality) or anyone who is cruel to or organizes animal fights will go to jail. It’s that simple of the bill for animal welfare, that made it to the legislative floor on Thursday, is passed into law.

The penalty for the practice of bestiality (defined as “sexual relations between a human and an animal”) shall be from six months to two years in jail; the same penalty applies for being cruel to an animal or organizing fights between animals.

The sanctions are part of the bill that for more than five years has been in process in the Legislative Commission on Environment (Comisión de Ambiente del Congreso).

The bill took its time due to long debates among legislators and agricultural sectors, to the point that some questioned the inclusion of Zoophilia as a punishable activity.

In the case of animal fights, the bill calls for action to be taken by the National Animal Health Service (Servicio Nacional de Salud Animal – SENASA).

A number of legislators, members of the legislative committee, in particular legislators of the Partido Liberacion Nacional (PLN) are in favour of the bill, including Ronny Monge, who said this government should pave the way against animal abuse, because “it was a campaign promise of Luis Guillermo Solis.”

For members of the legislative committee, the stumbling block to this bill, however, may be Otto Guevara, who made (failed) motions to allow “traditional activities with animals”.
